These terms are an agreement between you and Open Code ("we", "us"), which makes Max Messenger: the apps for Android, iPhone, Windows and macOS and the website maxmessenger.me (together, "Max"). By creating an account or using Max, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Max.
1Who can use Max
- You must be at least 13 years old, and old enough under the law where you live to use Max without a parent's or guardian's permission.
- You need a mobile number that you own or are allowed to use. We send a code to it, or to a device already signed in to your account, to confirm that it is yours.
- You may not use Max if we have closed your account before for breaking these terms, or if the law does not allow you to.
2Your account
- One phone number is one account. You can link computers to it from Settings → Linked devices, and remove them there.
- Keep your devices and the codes we send to yourself. Anyone holding a device that is signed in can read and send messages as you.
- You are responsible for what happens on your account. If you think someone else has access to it, remove that device in Settings and tell us at info@opencode-iq.com.
- Signing in on a new phone signs the old phone out. If a number stays unused with Max for some time and is then registered again, the earlier account on it is deleted, so if you give up a number, ask us to delete your account first.
3Privacy and encryption
- Our Privacy Policy explains what we collect and why. It is part of these terms.
- One-to-one chats are end-to-end encrypted by default, and a private group is when encryption is on for it: only the people in the chat can read the messages, and we cannot. Channels and public groups are not end-to-end encrypted, because anyone who joins can read them, and you can turn encryption off for a chat.
- Because we cannot read encrypted messages, we cannot recover them for you. Keep your own backups (Settings → Backup).
4Acceptable use
You agree not to use Max to:
- break the law, or help someone else break it;
- share sexual content involving children. We remove such content and the accounts that share it as soon as we become aware of it, and we report it to the authorities;
- harass, threaten or intimidate anyone, or stir up violence or hatred;
- send spam, bulk or automated messages, or messages people did not ask for;
- pretend to be another person or organisation, or mislead people about who you are;
- spread malware, phishing links or anything else designed to harm people, devices or data;
- infringe anyone's privacy, intellectual property or other rights, for example by sharing someone's private images without their consent;
- access, copy or interfere with Max or its servers in ways we did not intend, including creating accounts by automated means, scraping, or overloading the service.
5Your content
- What you send stays yours, or belongs to whoever owns it. You give us only the permission needed to deliver, store and show it so that Max works, for example keeping your encrypted messages on our servers until your devices collect them.
- You are responsible for what you send and share, and for having the right to share it.
- Anything posted in a channel or a public group can be read by everyone who joins it, and they can forward or save it.
6Groups and channels
- Whoever creates or runs a group or channel decides who may join and post, and can remove members and posts. They must follow these terms too.
- Anyone with an invite link can use it to join, so share links with care.
7Reports and enforcement
- You can block anyone, and report a message or an account from the app. A report sends us the account you report and your reason; for a message, also an excerpt of it or its file name, so that we can review it.
- We may remove content we can see, restrict features, or suspend or close accounts that break these terms or the law, or that put others at risk. Where we can, we will tell you why.
- We respond to valid legal requests from the authorities. Because of end-to-end encryption, we cannot hand over the content of encrypted messages.
8Services from other companies
- Max relies on other companies' services: app stores (Google Play and Apple's App Store), push notification services (Google Firebase Cloud Messaging and Apple Push Notification service) and SMS providers for verification codes. Their own terms apply to how you use them.
- Links in messages lead to other websites, which we do not control.
9Cost
- Max is free. Your mobile operator may charge you for data and SMS. If we ever offer paid features, we will show the price first and charge nothing without your agreement.
10Changes to Max
- We keep improving Max and may add, change or remove features. The apps update themselves, and an old version may stop working with the service after an update.
- We work to keep Max available, but we cannot promise that it will always be uninterrupted or free of errors. Maintenance, outages or events beyond our control can interrupt it.
11Ending your use of Max
- You can stop using Max at any time, and ask us to delete your account by writing to info@opencode-iq.com with your account's phone number. We may ask you to confirm it.
- We may suspend or close your account if you break these terms, if the law requires it, or if we stop providing Max, with notice where we can.
- Sections 5, 12, 13 and 15 continue to apply after your account is closed.
12Disclaimers
- Max is provided "as is" and "as available". As far as the law allows, we make no promises beyond those in these terms, including that Max will suit your needs or that every message will be delivered.
- Max is not an emergency service. Do not rely on it to reach emergency help.
13Limitation of liability
- As far as the law allows, we are not liable for indirect or consequential losses, or for lost data, profits or opportunities, arising from your use of Max.
- Nothing in these terms limits a liability that the law does not allow to be limited.
14Changes to these terms
- We may update these terms. We will publish the new version here with a new date and, for important changes, tell you in the app before they take effect. If you keep using Max after that, you accept the new terms.
15Law and disputes
- These terms are governed by the law that applies to you. Nothing in them takes away the rights you have under the law of the country where you live.
- If something goes wrong, please write to us first at info@opencode-iq.com; most problems can be solved that way.
